The following disclaimers apply to all property deals and information provided from Invest BMV to investor clients:
Property Misdescriptions Act 1991 "It should not be assumed that the property has all necessary planning, building regulation or other consents and we have not tested any apparatus equipment, fixtures, fittings or services, and can not verify that they are in working order, fit for their purpose, or within ownership of the sellers, therefore the buyer must not rely on the information. Neither have we checked the legal documentation to verify legal status of the property. Any interested party must not assume the information is correct until it has been verified by their own solicitor. Any measurements supplied are for general guidance only and as such must not be relied upon. Any interested party is advised to re-check the measurements before committing themselves to any expense. Nothing concerning the type of construction or the condition of the property is to be implied from the photograph(s) of the property. The sales particulars may change in the course of time, and any interested party is advised to make a final inspection of the property prior to exchange of contracts".
Misrepresentations Act 1967 "The property details have been prepared as a general guide only, and should not be relied upon as a basis to enter into a legal contract, or to commit expenditure. We are not authorised to make or give any representations or warranties in relation to the property either here or elsewhere, either on our own behalf or on behalf of the vendor or otherwise. Any interested party should rely solely on their own surveyor, solicitor or other professionals’ advice before committing themselves to any expenditure or other legal commitments. If any interested party wishes to rely upon any information from us then a specific written request should be made and specific written confirmation can be provided. We will not be responsible for any verbal statement made by any member of staff as only a specific written confirmation from a duly authorised member of staff should be relied upon. We will not be responsible for any loss other than where specific written confirmation has been supplied by a duly authorised member of staff".
Money Laundering Regulations 2007 "We have in place procedures and controls which are designed to forestall and prevent Money Laundering. If we suspect that a supplier, customer/client or employee is committing a Money Laundering offence as defined by the Proceeds of Crime Act 2002 we will, in accordance with our legal responsibilities, disclose the suspicion to the Serious Organised Crime Agency (SOCA)".
